LOUD & DIRTY — TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of the Loud & Dirty website (“Site”) and the purchase of products from Loud & Dirty (“we”, “us”, “our”). By accessing the Site or placing an order, you agree to these Terms.

1. Use of Site

You agree to use this Site only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Site.

We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion.

2. Orders & Acceptance

All orders placed through the Site are subject to acceptance.

We reserve the right to:

  • Refuse or cancel any order for any reason
  • Limit quantities per customer
  • Cancel orders due to pricing errors, inventory issues, or suspected fraud

An order is not considered accepted until it has been processed and fulfilled.

Once an order has been processed, it cannot be modified or canceled.

3. Pricing & Payment

  • All prices are listed in Canadian Dollars (CAD)
  • Prices are subject to change without notice
  • Applicable taxes are calculated at checkout
  • Payment must be received in full before order processing

By submitting payment, you confirm you are authorized to use the payment method provided.

You are responsible for any applicable taxes, duties, or import charges associated with your purchase.

4. Shipping & Delivery

  • Shipping times are estimates, not guarantees
  • Loud & Dirty is not responsible for delays caused by carriers, customs, or external disruptions

Risk transfers to the customer once the order is handed to the shipping carrier.

We are not responsible for:

  • Lost or stolen packages after shipment
  • Incorrect shipping addresses provided by the customer

For international orders, customers are responsible for any customs duties, taxes, or import fees imposed by their local authorities.

If an issue arises, we will assist where reasonable, but resolution is subject to the carrier.

5. Returns, Exchanges & Refunds

We accept returns on apparel under the following conditions:

Eligibility

  • Return requested within 14 days of delivery
  • Item is unworn, unwashed, and in original condition
  • All original tags and packaging included

Refunds

  • Returns are issued as store credit by default
  • Refunds to the original payment method may be issued at our discretion
  • Shipping costs are non-refundable unless the error was ours

Exchanges

  • Exchanges are accepted within 21 days of delivery
  • Subject to product availability

Non-Returnable

  • Final sale items (if marked)
  • Items showing signs of wear, damage, or alteration

We reserve the right to refuse any return that does not meet these conditions.

We reserve the right to limit or refuse returns from customers who demonstrate excessive or abusive return behavior.

6. Product Condition & Warranty

Products are sold as-is.

We do not guarantee:

  • Exact color matching across screens
  • Fit beyond standard sizing expectations

If you receive a defective item, you must contact us within 14 days of delivery with proof (photos).

7. Fraud & Chargebacks

We reserve the right to:

  • Refuse or cancel any order suspected of fraud
  • Restrict future purchases from flagged accounts

Initiating a fraudulent or unjustified chargeback may result in:

  • Permanent account restriction
  • Recovery actions where applicable

8. Intellectual Property

All content on this Site — including logos, designs, graphics, and text — is the property of Loud & Dirty.

You may not:

  • Reproduce, distribute, or modify any content without written permission
  • Use our brand or designs for commercial purposes

Products are intended for personal use and may not be resold or distributed without written permission.

9. Third-Party Services

We use third-party platforms to operate this Site, including Shopify for e-commerce infrastructure, payment processing, and order management.

We are not responsible for:

  • Service interruptions
  • Errors or failures caused by third-party systems

10. Limitation of Liability

To the maximum extent permitted by law:

Loud & Dirty is not liable for:

  • Indirect or consequential damages
  • Loss of profits, data, or use
  • Delays or failures outside our control

Your use of the Site and purchase of products is at your own risk.

11. Force Majeure

We are not liable for delays or failure to perform due to causes beyond our reasonable control, including but not limited to carrier disruptions, supply chain issues, labor disputes, or natural events.

12. Indemnification

You agree to indemnify and hold Loud & Dirty harmless from any claims, damages, or expenses arising from:

  • Your misuse of the Site
  • Your violation of these Terms
  • Your violation of any applicable laws

13. Privacy

Your use of the Site is also governed by our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of Ontario, Canada.

Any disputes will be handled in the courts of Ontario.

15. Changes to Terms

We may update these Terms at any time.

Continued use of the Site constitutes acceptance of any changes.
